EndPend Terms of Use
Version 2026-10-08
These Terms of Use (“Terms”) are an agreement between you and XenoDroid, Inc. (“XenoDroid”, “we”, “us”), which operates EndPend. They apply whenever you sign in to EndPend at endpend.com, beta.endpend.com, demo.endpend.com or any other EndPend address (the “Service”).
Please read them before you continue. You accept them by ticking the box and selecting Accept when EndPend asks you to. If you do not accept them, do not use the Service.
Part A applies to everyone. Part B also applies if you use EndPend as an applicant, a resident’s representative, a family member, or any other person who is not on the staff of the facility or agency that invited you.
Part A: Terms for all users
A1. What EndPend is
EndPend helps nursing facilities, their business offices and the people they work with organize Medicaid applications and pending cases: it collects information and documents, tracks deadlines and requests, prepares forms from the information entered, and records who did what.
EndPend is a tool. It is not:
- a government agency, or part of the Kentucky Department for Community Based Services (DCBS), the Cabinet for Health and Family Services, or any other agency;
- a law firm, and it does not give legal, financial, tax, or medical advice;
- the decision-maker on Medicaid eligibility. Only the agency decides eligibility, and EndPend cannot guarantee any result, approval date, or amount; or
- the official record of any facility, agency, or court.
Information in EndPend about rules, deadlines, and requirements is general and may be incomplete or out of date. Check anything important against the official notice, the agency, or your own adviser before you rely on it.
A2. Your organization’s agreement comes first
Most users are invited by a facility or other organization that has signed an agreement with us, including a Business Associate Agreement where health information is involved. If your organization’s signed agreement conflicts with these Terms, the signed agreement controls. Your organization decides who may use EndPend, what they may see, and what data goes into it, and it can remove your access at any time.
A3. Your account
- You must be at least 18 years old.
- Use only the account issued to you. Do not share your password, your sign-in code, or your multi-factor device, and do not let anyone else work while signed in as you. Every action in EndPend is recorded against the account that took it.
- Keep your contact details accurate.
- Tell your organization’s administrator, or us at support@xenodroid.ai, straight away if you think someone else has used your account or seen information they should not have.
A4. Using the Service properly
You agree to:
- use EndPend only for the cases and work you are authorized to handle;
- enter and open only the information you need for that work;
- enter information that is accurate to the best of your knowledge, and correct it when you learn it is wrong;
- keep information you see in EndPend confidential, and not copy, download, photograph, screenshot, print, export, or forward it except as your work requires and your organization allows; and
- follow your organization’s privacy and security rules.
You must not:
- upload anything you do not have the right to share, or any of the following unless your organization has told you in writing that it is approved: psychotherapy notes, substance-use-disorder treatment records, full payment-card numbers, biometric or genetic data, passwords or security keys, or attorney-client privileged material;
- upload malware or anything designed to harm the Service or other users;
- try to get around security, access controls, or usage limits, or test the Service’s security without our written permission;
- copy, reverse engineer, or resell the Service, or use it to build a competing product; or
- use the Service for anything unlawful, fraudulent, or abusive, including submitting information you know is false to a government agency.
A5. Health and personal information
EndPend holds sensitive information about residents and their families. When your organization is a HIPAA covered entity or business associate, we handle that information as its Business Associate under the signed Business Associate Agreement, and only for the purposes that agreement allows. Our Privacy Notice explains what we collect about you as a user and how we use it.
We do not sell personal information, and we do not use the information you or your organization enter to train artificial-intelligence models.
A6. Drafts, suggestions, and AI
Some EndPend features read documents, suggest next steps, fill in forms, or draft letters, sometimes using artificial intelligence. These are drafts and suggestions. They can be wrong or incomplete. Before you sign, send, file, or rely on anything EndPend prepares, a person must check it against the source documents. You and your organization remain responsible for what is submitted to an agency or anyone else.
A7. Who owns what
Your organization keeps its rights in the information and documents it puts into EndPend. We keep all rights in the Service: its software, designs, workflows, and content. We give you a limited, personal, non-transferable permission to use the Service for your organization’s work while these Terms and your organization’s access are in effect. If you send us feedback or ideas, we may use them without owing you anything, but we will not identify you, your organization, or any resident when we do.
A8. Changes and availability
The Service changes as we improve it and may sometimes be unavailable, including for maintenance or to protect security. Pre-release (beta and pilot) features may change or be withdrawn.
When we change these Terms in a way that matters, we will publish a new version with a new date and ask you to accept it the next time you sign in. You can always read the current version at /terms.
A9. Suspension and ending access
We or your organization may suspend or end your access if you break these Terms, if your account appears to be compromised, if your organization’s agreement ends, or if we need to protect people, data, or the Service. What happens to your organization’s information when access ends is set by your organization’s agreement.
A10. Disclaimers
To the extent the law allows, and except for the promises in your organization’s signed agreement, the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, that the information in it is complete or current, or that any application, appeal, or request will succeed.
A11. Limits on our liability
To the extent the law allows, and except as your organization’s signed agreement provides:
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or benefits, arising from your use of the Service; and
- if you use the Service as part of your work for an organization, any claim about the Service is a matter between that organization and us under the signed agreement, and we have no separate liability to you personally.
Part B sets a separate limit for participants. Nothing in these Terms limits liability that the law does not allow to be limited.
A12. General
- Law. Kentucky law governs these Terms, without regard to conflict-of-law rules. Courts in Kentucky decide disputes about them.
- Whole agreement. These Terms, the Privacy Notice, and (where it applies) your organization’s signed agreement are the whole agreement about your use of the Service.
- If a part is invalid, the rest still applies.
- No waiver. If we do not enforce a term straight away, we can still enforce it later.
- Transfer. You may not transfer these Terms. We may transfer them to a company that takes over the Service, and your rights stay the same.
- Events outside our control excuse delays they cause, but not our duties to protect data and respond to security incidents.

Part B: Additional terms for applicants, representatives, and family members
Part B applies if you use EndPend as an applicant for Medicaid, as someone acting for an applicant or resident (for example a family member, authorized representative, power of attorney, or guardian), or as anyone else who is not on the staff of the facility or agency that invited you (a “Participant”).
B1. Who you are dealing with
The facility or agency that invited you decides what you can see and do in EndPend, and remains responsible for its own work on the case. We provide the tool. Questions about the case itself (what the facility needs from you, what happens next, a decision by DCBS) go to the facility or the agency.
B2. Acting for someone else
If you act for an applicant or resident, you confirm that you have the legal authority to do what you do in EndPend for them, and that you will keep that authority current. In Kentucky, apart from a parent or guardian applying for a minor child, a person acting for an applicant (a spouse included) generally needs a signed authorized-representative form (MAP-14), a power of attorney, or a court order, and the facility may ask for a copy. If your authority ends or changes, tell the facility straight away and stop acting under it.
B3. Accurate information
Medicaid applications and the documents you provide must be true and complete. Giving false information, or leaving out information you are required to give, on a Medicaid application can lead to denial, repayment, and criminal penalties. EndPend does not check that what you enter is true. You are responsible for what you enter and sign.
B4. Not legal advice and not representation
EndPend explains requirements in general terms and prepares forms from the information you and the facility enter. It does not choose a legal strategy for you, does not decide what to disclose, and does not represent you before DCBS or at a hearing. If you have questions about asset transfers, trusts, spousal protections, a denial, or an appeal, you may want to speak to a lawyer. Free help may be available from Kentucky’s legal aid programs.
B5. Electronic records and signatures
By accepting these Terms you agree to receive notices, copies, and records from EndPend electronically and, where EndPend offers it, to sign documents electronically. An electronic signature you make in EndPend is meant to have the same effect as signing on paper.
- You can ask the facility for a paper copy of any document you signed or received through EndPend, at no charge.
- You can withdraw this consent at any time by telling the facility or emailing support@xenodroid.ai. Withdrawing does not undo anything already signed; after that, the facility will send and collect documents on paper.
- You need a current web browser, an email address, and a way to view and save PDF files. If that changes in a way that stops you reading or keeping records, we will tell you.
- Some agencies may still require a handwritten signature on certain forms. The facility will tell you when that applies.
B6. Your information
The facility’s privacy notice (its HIPAA Notice of Privacy Practices) explains how the facility uses and shares the resident’s health information, and how to ask for access or corrections. Our Privacy Notice explains how we handle your account information.
B7. Limit on our liability to Participants
To the extent the law allows, our total liability to you for any claim about the Service is limited to one hundred US dollars (US$100). This limit does not apply to liability that the law does not allow to be limited, including liability for our gross negligence, willful misconduct, or fraud, or for breaking our legal duties to protect your information.
B8. Disputes
Before bringing a claim, please contact us at support@xenodroid.ai so we can try to resolve it. If we cannot, you may bring your claim in the courts of the Kentucky county where the facility that invited you is located, or in small-claims court where it qualifies. Nothing in these Terms takes away rights you have as a consumer under the law.
